Terms of service

The terms on which Facto provides Facto Lite. Plain language on purpose — if a clause here is unclear, ask us rather than guessing.

1. The agreement

These terms apply between Facto and the company whose account is created on lite.myfactoapp.com. By creating an account, the person doing so confirms they are authorised to accept these terms on that company’s behalf.

2. Your account

  • You are responsible for who you give access to, and for what they do with it. Administrators can add, remove and restrict users at any time.
  • Sign-in credentials are personal and should not be shared. Tell us promptly if you believe an account has been compromised.
  • You are responsible for the accuracy of what your company enters, including anything used to calculate attendance, leave or salary.

3. The free trial

A new account gets all features free for 60 days. No payment details are taken and there is nothing to cancel. When the 60 days end:

  • For seven further days the account is read-only. Everything can still be read, exported and printed; new entries are paused.
  • Marking attendance — checking in and out, and punches sent by a biometric reader — continues to work throughout those seven days.
  • After that, the modules are switched off. Nothing is deleted. Switching a module back on restores access to everything already in it.

We may extend a trial at our discretion. We will not shorten one that has already started.

4. Fees and payment

  • Prices are published at /pricing, are in Indian Rupees and are exclusive of GST, which is added on the invoice.
  • Modules are bought independently. Prices are banded by the number of people who sign in.
  • There is no online checkout. Subscriptions are invoiced and settled directly with us, monthly or annually as agreed.
  • Invoices are payable within the period stated on them. Continued non-payment may lead to the account being made read-only and then switched off, on the same basis as an expired trial — and, as with an expired trial, without anything being deleted.

The software does not enforce the user bands. If your team grows past the band you are on, tell us and we will move you to the next one from the following billing period.

5. Term and cancellation

A subscription runs for the term you have paid for and renews unless you tell us otherwise. There is no minimum contract and no notice period beyond the current term. On cancellation you keep access until the end of the term you have paid for, and you can export your data at any point before and during the read-only period that follows.

6. Acceptable use

You agree not to use the service to:

  • Break the law, or store data you have no right to hold.
  • Attempt to reach another company’s data, or to probe, scan or disrupt the service.
  • Resell or provide the service to a third party as if it were your own, unless we have agreed that in writing.
  • Upload malicious code, or content that infringes somebody else’s rights.

We may suspend an account that is causing harm to the service or to others, and we will tell you why.

7. Your data

Your data remains yours. We process it to provide the service and for no purpose of our own — see the privacy policy. You can export it at any time. If you ask us to close the account, the data is removed 90 days later; that window exists so a deletion asked for by mistake can be undone.

8. Availability and support

We work to keep the service available and we do not commit to a published uptime figure. There will be planned maintenance from time to time, and we will give notice inside the product where we can. Support is included in every subscription, by email and phone, at no extra charge.

9. Changes to the service and to these terms

The software is updated continuously and features change. We will not remove something material without telling you in the product first. If these terms change materially, we will say so in the product rather than quietly editing this page; the date at the top is the date the current text was published.

10. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, our total liability to you in any twelve-month period is limited to the fees you paid us in that period, and neither party is liable to the other for indirect or consequential loss.

The service helps you record and calculate things — attendance, leave, salary, statutory deductions. It does not replace your own checks. Figures produced by the software should be reviewed before they are paid or filed, which is why a payroll run has an approval step in front of it.

11. Governing law

These terms are governed by the laws of India. We will tell you which courts have jurisdiction on request, and it will be stated on your agreement with us.
