Overtime pay = (monthly ordinary wage ÷ 208) × 2 × overtime hours. The ordinary wage includes Basic, DA and allowances such as HRA, but not bonus; and double is the legal minimum under the Factories Act.

How it is worked out

The working, step by step.

  1. Add up the monthly ordinary wage: Basic, dearness allowance and the allowances paid every month. Leave out bonus and any overtime already paid.
  2. Divide by 208 — 26 working days of 8 hours — for the ordinary hourly rate.
  3. Double it for the overtime rate an hour. More than double is allowed; less is not.
  4. Multiply by the overtime hours worked in the month.

Monthly ordinary wage

Your regular monthly pay: Basic, DA, and the allowances you get every month, such as HRA and conveyance. The Supreme Court held in 2026 that these allowances count.

Leave out bonus, incentives and any overtime already paid. If unsure, use your gross monthly salary from your payslip.

Overtime hours

Hours you worked beyond the normal limit. Under the Factories Act that is more than 9 hours in a day or 48 hours in a week.

Add up the extra hours for the month. Your attendance or overtime register shows them.

For example: Working 10 hours a day for 20 days is 20 overtime hours.

Overtime rate

How many times your normal hourly pay each overtime hour earns. The legal minimum is 2× — double. An employer can pay more, never less.

Hourly ordinary rate

Your normal pay for one hour: the monthly ordinary wage divided by 208, which is 26 working days of 8 hours.

For example: ₹30,000 a month ÷ 208 = ₹144.23 an hour.

How is overtime calculated in India?

At twice the ordinary rate of wages for every hour worked beyond the daily or weekly limit. The ordinary hourly rate is the monthly wage divided by 208: at ₹30,000 a month that is ₹144.23, so an overtime hour pays ₹288.46.

Does the ordinary wage include HRA?

Yes. The Supreme Court held in January 2026 that the ordinary rate of wages for overtime includes compensatory allowances such as HRA and transport, and excludes only bonus and overtime itself.

Why divide by 208?

208 is 26 working days of 8 hours, the month the ordinary hourly rate is worked out on.

Does this apply to office and shop staff?

The double rate is the Factories Act’s rule for factory workers. Offices and shops follow their state’s Shops and Establishments Act, which sets its own hours and overtime rate — check yours.
